Government of India on the path in Setting up ‘‘India Data Management Office (IDMO)” and to bring out A New Data Governance Policy Framework

GoI Inviting feedback and inputs on Draft National Data Governance Framework Policy

The Government of India, Ministry of Electronics and Information Technology (MeitY) has invited inputs on the Draft National Data Governance Framework Policy (NDGFP) that aims to enhance access, quality, and use of data, in line with the current and emerging technology needs of the industry and for the protection of Digital Interest in India.

Earlier the Government had placed the “The Personal Data Protection Bill (PDPB), 2019” in the parliament, and subsequently the same was withdrawn to refine the Nuances and Implementation of the Bill, and also to include “Non-Personal Data” into the ambit of similar Law.

The Government had also placed the ‘Draft India Data Accessibility and Use Policy, 2022’, which again drew strong criticism after it was on open domain for public consultation in February. The intention of the Government through this said draft was to “radically transform India’s ability to harness public sector data”. The document had also proposed to allow the licensing and sale of public data by the government to the private sector. The criticism were genuine and also for the fact that the Policy would have certainly invited Judiciary Review. It is also pertinent to mention that the Government of the day is cautious of the fact that even the IT Rule 2021 is being iterate for Judicial and Constitutional Validly by the Hon’ble Supreme Court of India.

It is at this juncture that the Government of India has come out with the “National Data Governance Framework Policy (NDGFP) (Draft) May 2022”.

“The NDGFP standards and rules will ensure data security and informational privacy. This Policy shall be applicable to all government departments and entities and rules and standards prescribed will cover all data collected and being managed by any government entity,” the Ministry of Electronics and Information Technology (MeitY) said in the latest draft policy.

The new proposed Framework Policy also proposes a ‘‘India Data Management Office (IDMO)” shall be set up under the Digital India Corporation (DIC) under MeitY’. This Office will be responsible for framing, managing and periodically reviewing and revising the Policy. This  will also ensure derivation of policies that would be applicable to all non-personal datasets and data and platform, rules, standards governing its access and use by researchers and start-ups; and State governments would also be encouraged to adopt the provisions of the Policy and rules, standards, and protocols as applicable.

The policy also talks about Data Management Unit (DMU) and Chief Data Officer (CDO) in the ecosystem. Every Ministry/Department shall have “DMUs” headed by a designated “CDO” who shall work closely with the IDMO for ensuring implementation of the Policy.

The document has also provided essential importance to ‘Data Anonymisation’. For this the  data anonymisation, the IDMO will setup and publish, data anonymisation standards and rules to ensure informational privacy is maintained.
